The doctor talks about the problem faced by Japanese father in taking the baby home after surrogacy in India because of the Japanese Law. In the Japanese Manji baby case, the problem was entirely with the Japanese law. The Japanese couple that started the surrogacy process and then when the surrogate mother got pregnant, during the pregnancy, the Japanese couple divorced and as per Japanese law, the single father cannot take back a baby home if it is genetically related. Ultimately, it was the man’s, the genetic father’s own mother had to come down, sign for and take the baby back home. The problem was entirely with the Japanese law and I think all these issues have been sorted out in the ICMR guidelines and fine-tuned so that the whole process has become much simpler then it was 3 years ago.” Indian surrogacy clinics and treatment centers are governed by ICMR guidelines which are fine tuned to make the process of surrogacy simpler for the couples visiting the country to fulfill their dream of having their own child. |

In this video, a renowned Indian doctor talks about inducing labor pain in surrogacy for childbirth.Induction is a method of artificially stimulating childbirth in a woman with the help of medications and other processes. Decision to induce is taken only if it is in the best interest of the surrogate motherand the child.
Video Narration“Once we are given an expected date of arrival of the baby, I understand we need to book our flights. But what happens if the baby comes late? Is the surrogate mother induced? Again this question is entirely an obstetric question and the obstetrician will decide induction based on the best interest of the mother and baby. Video Narration“Will my baby’s birth certificate mention the surrogate mother’s name or in any way refer to surrogacy? No, the Indian ICMR guidelines strictly say that the surrogate mother’s name will never be on the birth certificate. It will be the intended parents or the genetic parent’s name and in case of a single father, it will just have the single genetic father’s name on the birth certificate.” Surrogate mothers in India are not considered the legal mothers of the baby according to the law; the intended parents or the genetic parents are recognized as the real parents. Therefore birth certificate can only have the name of the intended parents or genetic father’s name in case of same sex couple. |
