The Republic of Georgia’s Laws on Surrogacy

According to the Parliament of Georgia’s website, the following are some of the laws on Georgia surrogacy procedures:

“Article 143. Section b: Extracorporeal fertilization (IVF) is allowed if a woman has no uterus, for the purpose of transfer and growth of the embryo obtained as a result of fertilization to the uterus of another woman (“surrogate mother”). The couple’s written consent is obligatory.

The couple is considered to be parents in case of the childbirth with the responsibility and authority ensuing from it. A donor or a “surrogate mother” has no right to be recognized as a parent of the born child. “

 

Other facts about Georgia surrogacy

  • The birth certificate is issued within 24 hours after birth, as with any other child
  • After birth, the baby is registered under the names of the intended parents
  • During registration, the intended parents do not need the consent of the surrogate mother

Following is the surrogacy video narration.

 

“I am from the admin staff. I am preparing the baby pick-up documents.

This is a sort of file that we give which is baby pick-up documents. So this is a complete set of documentation of the entire pregnancy which includes the pregnancy ultrasound scans right from day 1. So this is what you would see initially on a pregnancy scan. It’s just 2 tiny dots.

 

This couple had twins – a boy and a girl and these are the most initial scan pictures followed by the heart beat scan pictures and then scans every 2 weeks till they reach about 11 weeks of pregnancy and a very important scan at this stage, which is being circled, to tell you if your baby is normal and healthy or if it has any form of genetic abnormalities.

 

Following this, scans are done on a monthly basis, as you can see around 20 weeks, 24, about 28 to 30 weeks, 34 weeks. So scans are done at regular intervals till finally the baby is born.  Now after the birth of the baby, the delivery report is given. So this is like a birthing report where via caesarean section a boy and a girl were born and this documentation is then completed with the embryology report and the contract.

 

This is the contract that the parents have signed with the surrogate mother and a no objection certificate given by the surrogate mother after the birth of the baby to state that she has no objection in the parents taking the baby home.  So this is a complete set of baby pick-up documents.”
