“Germany, Spain, Portugal, Mexico, Italy – all these are basically catholic countries and the church influences the state and in all these catholic countries, surrogacy is deemed illegal. Any child born out of surrogacy, the respective local consulates don’t give exit passports or travel passport papers and this was the problem.
Now with the ICMR guidelines when a patient comes from any of these catholic countries, we ask them to sign an undertaking that says they have talked to their respective consulates and have made provision for taking their own babies back. The responsibility for taking the babies back rests with them and the consulate. So once they sign such an affidavit, only then we take in couples from such countries where surrogacy is deemed illegal.”
The surgeon explains that in countries where Catholic Church beliefs influence the state and consider surrogacy illegal, many childless couples look for surrogacy abroad. In such scenarios, ICMR guidelines in India meet the need of the couples. It requires the couple to sign a contract stating that they have fulfilled all legal provisions to take their baby back home. It is solely the couple’s and their consulate’s responsibility.
