Surrogacy Laws in New Zealand

Under the New Zealand laws, in case of both commercial and gestational surrogacy abroad, the surrogate mother is considered the mother of the child unless the child is adopted by the New Zealand couple through the adoption process as prescribed in the legislature of the country.

Before the process of adoption starts, intended parents must contact the Department of internal affairs and Child, Youth and Family services to ensure compilation of the process in accordance with the relevant New Zealand laws.

Allotment of Citizenship to a child born as a result of international surrogacy and adopted by a New Zealand couple is governed by Citizenship Act 1977 and the Status of Children Act 1969.

Surrogacy for Kiwis can be a complex issue as commercial surrogacy is legally prohibited and domestic surrogacy options for couples are limited.
