The surrogacy doctor states that as per ICMR guidelines this type of surrogacy is known as traditional surrogacy. It is not legal in India. So the surrogate cannot be the egg donor.

India Surrogacy Doctor discusses Gestational and Natural Surrogacy

“Gestational surrogacy means the genetic mother is different from the surrogate mother. The surrogate mother can never have a claim or a legal jurisdiction or rights over the baby carrying for the genetic parents. There is absolutely going to be zero chances of any legal problems and any hindrances in the couple taking the baby back home. ICMR guidelines do not recognize traditional surrogacy. The only type of surrogacy allowed in India is gestational surrogacy where the genetic mother is different from the surrogate mother. The surrogate mother only lends her womb for the duration of pregnancy and hands over the live baby after delivery to the genetic parents.”

As the surrogacy doctor states, gestational surrogacy in India is legal whereas traditional surrogacy is not. Because the surrogate mother is not genetically related to the child in gestational surrogacy, therefore, she cannot claim the child.
