Ukraine Surrogacy Laws

• An excerpt from Ukraine legislation (The Family Code of Ukraine, Article 123.2) concerning surrogacy states that  “If a human embryo conceived by a couple as a result of the application of assisted reproductive technology is transferred into the body of another woman, the parents of the child are the couple.”
• No adoption is required after the Ukrainian surrogate mother gives birth; the commissioning individual is automatically listed as the parent on the child’s birth certificate.
• Gender selection is legal in Ukraine.

As stated in their family code, surrogacy can be indicated for women having difficulties getting pregnant, as in the following cases:

• Absence of a womb, whether acquired or inborn
• Impossibility of pregnancy or delivery from reproductive system deformations, or if pregnancy poses a great life risk to a woman
• Womb cavity synechiae

A Ukrainian surrogate mother should be 25-35 years of age, and deemed physically fit and mentally healthy. She should also have had at least one child before taking part in a surrogacy procedure.

Ukrainian Surrogate mothers are:

• 25-35 years old
• Physically and mentally fit as evaluated by medical doctors
• Have had at least one successful uncomplicated pregnancy and childbirth
• Have passed numerous infectious diseases tests.
• Have no history of substance abuse; do not drink or smoke

Medical Tests for Couples before Surrogacy

The following tests are required for the couple before surrogacy can be started in Ukraine:

For the husband:

• HIV, Syphillis, Hepatitis B and Hepatitis C screening
• Sperm count

For the wife:

• Gynecological exam
• Vaginal ultrasound
• HIV, Syphillis, Hepatitis B and Hepatitis C screening
• Gram stain smear
• Clinical blood analysis

Visiting Ukraine for Surrogacy

Most couples need to visit Ukraine during the surrogacy process two to three times. A typical scenario is below:

1^st visit: Meeting the doctor and your personal coordinator, leaving sperm samples, passing the tests (if they were not done in home country), signing the contracts and meeting the surrogate candidates

2^nd visit: If no egg donor is required, the intended mother goes to Ukraine for egg harvesting.

3^rd visit: The much awaited birth; followed by processing the baby’s documents for the intended parents to bring home to your home country.

Commercial surrogacy in Ukraine is legal, and there are no complicated procedures for bringing the baby home after birth, since all contracts are signed by all parties involved at the start of the process. Often the last procedure of processing the documents only takes a week or two and then the baby can be easily brought home by the new parents.
